Acceptable Use Policy

A. Core Principles

TenPod exists to streamline Recruitment, HR and Payroll workflows safely. You must:

  • use TenPod lawfully, with appropriate consents/authority;
  • apply human oversight to AI Outputs, especially for high‑impact decisions (hiring, termination, compensation, immigration);
  • protect credentials and any personal information you process;
  • respect TenPod’s security controls and other customers’ use of the Service.

B. Prohibited Conduct

You (and anyone using your account) must not:

  1. Unlawful activities
    • Violate any law (privacy, employment, anti‑discrimination, surveillance, sanctions/export).
    • Process personal information without a lawful basis or necessary authority/consent.
  2. Abuse of identity or work‑rights features
    • Perform identity or work‑rights checks without lawful authority/consent, or for individuals for whom you have no legitimate business purpose.

  3. Security violations
    • Attempt to bypass or defeat authentication, authorisation, rate limits, or metering; perform scanning, scraping, probing, penetration testing, or DDoS without prior written authorisation from TenPod.
    • Introduce malware, backdoors, crypto‑mining, or materially disrupt the Service.
  4. Data misuse
    • Upload or share personal information beyond what is necessary for your legitimate purpose; store government identifiers or identity documents where not reasonably required; collect or process data about minors unless lawfully permitted and strictly necessary.
    • Use Outputs to deanonymise individuals, build profiles, or infer sensitive attributes without a lawful basis.
  5. Discrimination & automated decision‑making
    • Use the Service to discriminate on unlawful grounds.
    • Rely solely on AI Outputs for decisions that materially affect individuals’ rights or opportunities, without meaningful human review.
  6. Spam & unlawful marketing
    • Send commercial electronic messages without consent or without a functional, low‑cost unsubscribe implemented within required timeframes. ACMA+1
  7. Intellectual property & fair use
    • Infringe others’ IP; use the Service to generate or distribute content that violates third‑party rights; benchmark or disclose performance for competitive purposes without consent.
  8. Misrepresentation & deception
    • Impersonate others; misrepresent your identity or affiliation; attempt prompt‑injection or other manipulations to elicit confidential information or bypass guardrails.
  9. High‑risk uses
    • Use in safety‑critical environments where failure could result in death or serious injury; use for unlawful surveillance or to identify individuals from biometrics outside lawful processes.

C. Customer Security Responsibilities

  • Implement least‑privilege access; rotate and protect API keys; enable MFA where available; review user access quarterly.
  • Maintain your own backups/exports as needed for legal recordkeeping.
  • Promptly notify TenPod at legal@tenpod.com.au of any suspected compromise of your credentials or unauthorised access.

D. Rate Limits & Fair Use

  • Excessive or abusive traffic (e.g., high‑frequency polling, concurrency that degrades service, automated scraping) may be throttled or blocked.
  • Do not circumvent metering of node triggers.

E. Enforcement

TenPod may investigate suspected violations (including reviewing logs), suspend or terminate access, remove content, preserve evidence, and report unlawful activity to authorities. Where appropriate and lawful, we will give notice and an opportunity to cure.

F. Changes

TenPod may update this AUP; material changes will be communicated where practicable.
